These Terms and Conditions apply to all services and products provided by Thrive and Shine Women’s Wellness Ltd, including (without limitation) women’s health physiotherapy, one-to-one appointments, packages, Pilates classes, CONTROL hypnosis sessions, workshops, gift vouchers, referral schemes, competitions/prize draws, and digital courses/products.
By booking an appointment, enrolling in a class, purchasing a package, attending a workshop, buying a voucher, entering a prize draw, or purchasing digital content, you agree to these Terms.
You should retain a copy for your records.
1. General Provisions
1.1 Service Location / Availability
Our services are primarily offered within the United Kingdom. If you are located outside the UK, you must contact us before booking so we can confirm whether we are able to provide the relevant service.
1.2 Priority of Terms
These Terms take precedence over any other terms (including your own terms), any course of dealing, or any industry practice.
1.3 Non-excludable Liability
Nothing in these Terms excludes or limits liability for:
(a) death or personal injury caused by negligence;
(b) fraud or fraudulent misrepresentation; or
(c) any liability which cannot lawfully be excluded or limited.
1.4 Limitation of Liability (General)
Subject to clause 1.3, our total liability arising out of or in connection with any service or product shall be limited to the amount you paid for the relevant service or product.
1.5 Indirect Loss
Subject to clause 1.3, we are not liable for any indirect or consequential losses.
1.6 Your Responsibility
You are responsible for providing accurate information, following professional advice given, and seeking appropriate medical attention where required.
2. Medical Disclaimer
2.1 Any information, guidance, exercises or education we provide is not a substitute for medical diagnosis or treatment by your GP/doctor/healthcare provider.
2.2 Do not delay seeking medical advice, disregard medical advice, or discontinue medical treatment because of information we provide.
2.3 If you think you may be suffering from a medical condition, seek appropriate medical attention promptly.
2.4 Nothing in this disclaimer limits or excludes any liability that may not be limited or excluded by law.
3. Women’s Health Physiotherapy & One-to-One Appointments
3.1 Registration and Consent
3.1.1 You must complete any required registration and consent forms before treatment.
3.1.2 You must disclose relevant medical history, symptoms and health changes accurately.
3.2 Initial Appointments (New Patients) – Deposit and Booking
3.2.1 A 50% deposit is required at the time of booking to secure an Initial Appointment.
3.2.2 The deposit reserves dedicated clinical time and is non-refundable.
3.2.3 A booking is not confirmed until the deposit is received.
3.3 Initial Appointments – Cancellation & Rescheduling
3.3.1 More than 48 hours’ notice: your deposit may be transferred once to a new appointment date/time (subject to availability).
3.3.2 24–48 hours’ notice: your deposit is retained and a new deposit is required to rebook.
3.3.3 Less than 24 hours’ notice or non-attendance: the full appointment fee remains payable. Any outstanding balance must be settled before further bookings are accepted.
3.3.4 Rescheduling is subject to availability. Multiple reschedules may require a new deposit at our discretion.
3.3.5 Non-payment does not constitute cancellation and does not remove liability for fees due.
3.4 Follow-Up Appointments – Cancellation Fees
3.4.1 Follow-up appointments do not require a deposit unless otherwise specified.
3.4.2 Cancellation terms for follow-ups:
(a) 48+ hours’ notice: no charge.
(b) 24–48 hours’ notice: 50% of the appointment fee payable.
(c) Less than 24 hours’ notice or non-attendance: 100% of the appointment fee payable.
3.4.3 Outstanding fees must be settled before further bookings are accepted.
3.5 Effectiveness of Treatment
3.5.1 Results are not guaranteed and vary by individual.
3.5.2 We do not offer refunds for lack of improvement or outcome.
3.6 Cancellations by the Company
3.6.1 We will make reasonable efforts to provide advance notice where possible.
3.6.2 Where an appointment is cancelled by us, we will offer rescheduling at the earliest available time. We are not liable for additional costs or inconvenience.
4. Packages (One-to-One)
4.1 Purchase and Payment
4.1.1 Packages are discounted bundles of sessions and must be paid in full at purchase.
4.1.2 Package pricing reflects a commitment to complete the full bundle.
4.2 Validity Periods
4.2.1 3-session package: valid for 3 months from date of purchase.
4.2.2 6-session package: valid for 6 months from date of purchase.
4.2.3 Unused sessions expire after the validity period.
4.3 Refund Policy
4.3.1 Packages are non-refundable once purchased.
4.3.2 No partial or pro-rata refunds will be issued for unused sessions.
4.3.3 The discounted rate is conditional upon completion of the full package.
4.4 Cancellation Within a Package (Package Benefit)
4.4.1 As a benefit of package purchase:
(a) 24+ hours’ notice: session may be rescheduled (subject to availability).
(b) Less than 24 hours’ notice or non-attendance: session is forfeited.
4.4.2 These cancellation terms apply equally to all sessions within the package.
4.5 Credits / Conversions
4.5.1 Any conversion of unused sessions to alternative services is at our sole discretion.
4.5.2 No cash alternative is available for unused package sessions.
5. WhatsApp Support (Package Clients Only)
5.1 Where WhatsApp support is offered, it is available during the active package period and for a 7-day grace period after the final session.
5.2 WhatsApp support is for brief clarification of advice provided in sessions only and is not suitable for urgent, emergency or acute medical matters.
5.3 Messages are monitored during working hours and we aim to respond within 1–2 working days.
5.4 WhatsApp support ends after the package validity period and/or grace period (whichever is sooner).
6. CONTROL Hypnosis
6.1 Consultation
6.1.1 Initial consultations may be offered free of charge.
6.1.2 Failure to attend a scheduled consultation without notice will result in a £50 non-attendance charge.
6.2 Sessions and Packages
6.2.1 Paid sessions/packages must be paid in full.
6.2.2 Packages are non-refundable once commenced.
6.2.3 Cancellation terms mirror clause 4.4.
6.2.4 No specific outcome is guaranteed.
7. Workshops
7.1 Workshops are date-specific events.
7.2 Payment in full is required at the time of booking.
7.3 All workshop bookings are non-refundable.
7.4 If we cancel a workshop for any reason, you will be offered either:
(a) transfer to an alternative date (subject to availability), or
(b) a full refund.
7.5 We are not liable for any additional costs incurred due to workshop cancellation.
8. Pilates Terms and Conditions
8.1 Registration & Health Responsibility
8.1.1 A completed registration form must be submitted prior to attending your first class.
8.1.2 You are responsible for ensuring all medical information provided is accurate and up to date.
8.1.3 You must inform the instructor of any injury, surgery, pregnancy, diagnosis, medication changes, or change in physical capability.
8.1.4 Participation confirms you are medically fit to exercise and understand the risks involved.
8.1.5 The Company accepts no responsibility for injury except where caused by proven negligence.
8.2 Trial Sessions
8.2.1 A paid trial session is available prior to committing to a block booking. A trial is not mandatory but is recommended.
8.2.2 Trial sessions must be paid in full at the time of booking.
8.2.3 A booking is not confirmed until payment has been received.
8.2.4 Trial sessions are strictly non-refundable.
8.2.5 Failure to attend a booked trial session without prior notice will result in forfeiture of the session fee.
8.2.6 Payment on the day is not accepted unless expressly agreed in advance at our sole discretion.
8.3 Matwork Pilates – Half-Term Block Structure
8.3.1 Matwork classes are booked and paid for in half-term blocks.
8.3.2 Your class place is ongoing and will automatically roll into the next half term unless cancelled in accordance with clause 8.6.
8.3.3 Payment in full is required prior to the start of each half term.
8.3.4 Invoices must be paid within seven (7) days of issue.
8.3.5 A place in class is only secured once payment has been received.
8.3.6 Failure to pay an invoice does not constitute cancellation.
8.3.7 If proper notice has not been given, you remain liable for the full cost of the upcoming half term whether or not you attend.
8.3.8 Your place remains reserved until valid written notice is received.
8.3.9 Continued non-payment may result in suspension from attending classes until outstanding balances are settled.
8.4 Non-Refundable Policy – Matwork
8.4.1 All half-term block payments are non-refundable.
8.4.2 Once payment has been made, no refund or credit will be issued for any reason including (without limitation) illness, injury, surgery, holidays, work commitments, or personal circumstances.
8.4.3 Missed classes are non-refundable.
8.4.4 No partial refunds will be issued.
8.4.5 The non-refundable nature of block bookings reflects the reservation of a limited-capacity place.
8.5 Transfers & Make-Up Sessions – Matwork
8.5.1 Transfers to an alternative class may be permitted:
subject to availability;
must be requested in advance;
are not guaranteed.
8.5.2 Transfers do not alter the non-refundable status of the block.
8.5.3 No transfers will be offered for classes missed without prior notice.
8.6 Notice to Withdraw from Next Half Term
8.6.1 A minimum of four (4) weeks’ written notice is required if you do not wish to continue into the next half term.
8.6.2 Notice must be received at least four weeks before the start date of the upcoming block.
8.6.3 If notice is not received within this timeframe, the next half-term fee remains payable in full.
8.6.4 Non-attendance does not remove liability for payment where notice has not been properly given.
8.7 Chair Pilates – Monthly Structure
8.7.1 Chair Pilates classes are paid monthly in advance.
8.7.2 Your place is ongoing and continues month to month unless cancelled in accordance with clause 8.7.9.
8.7.3 All monthly payments are non-refundable.
8.7.4 Missed classes are non-refundable.
8.7.5 Transfers to a different class within the same month may be permitted:
subject to availability;
must be arranged in advance;
are not guaranteed.
8.7.6 Transfers do not alter the non-refundable status of the monthly payment.
8.7.7 Non-payment does not constitute cancellation.
8.7.8 Continued non-payment may result in suspension of attendance until outstanding balances are settled.
8.7.9 A minimum of four (4) weeks’ written notice is required to cancel your ongoing place.
8.7.10 Notice must be received prior to the start of the next billing month.
8.7.11 Failure to provide notice means the next month remains payable in full.
8.8 Instructor Cancellations
8.8.1 If a class is cancelled by the instructor, a credit will be applied to the next invoice or future booking. No cash refund will be issued.
8.8.2 We are not liable for additional costs incurred due to class cancellation.
9. Gift Vouchers
9.1 Gift vouchers are valid for six (6) months from the date of issue unless stated otherwise.
9.2 Gift vouchers are non-refundable and not redeemable for cash.
9.3 Gift vouchers cannot be extended beyond expiry and any unused balance will be forfeited.
9.4 Gift vouchers may not be used in conjunction with other offers unless expressly stated.
9.5 We reserve the right to refuse redemption where there is reasonable suspicion of fraud, tampering or unauthorised alteration.
10. Referral Scheme (£10 / £10)
10.1 The new patient receives £10 off their first full-priced Initial Appointment.
10.2 The referrer receives £10 credit once the new patient has attended and paid for their Initial Appointment.
10.3 The referral voucher must be presented at the first appointment (at the appointment where payment is taken).
10.4 The referral offer is valid for new patients only (not existing or returning clinical clients).
10.5 One voucher per person per appointment. No cash alternative.
10.6 The £10 credit is applied to the referrer’s account and may be used against future services.
10.7 Credits are valid for six (6) months from date of issue.
10.8 There is no limit to the number of referrals a participant may make. Referral credits may be accumulated without restriction.
10.9 We may amend, suspend or withdraw the scheme at any time at our discretion.
11. Digital Courses & Online Products
11.1 Upon purchase, immediate access to digital content is granted.
11.2 By completing purchase, you request immediate access and acknowledge that your statutory cancellation right under the Consumer Contracts Regulations 2013 is waived once access begins.
11.3 All digital purchases are non-refundable once access has been granted.
11.4 All digital content is provided for personal use only and is not to be shared, redistributed or resold.
12. Intellectual Property & Fair Use (Important)
12.1 All materials provided by the Company (including but not limited to course content, worksheets, PDFs, videos, recordings, workshop materials, class plans, branding, and written content) remain the intellectual property of the Company unless expressly stated otherwise.
12.2 You are granted a personal, non-transferable licence to use materials for your own private use only.
12.3 You must not copy, reproduce, distribute, publish, sell, share, licence, transmit, upload, or exploit Company materials in whole or in part without our prior written consent.
12.4 This includes (without limitation) copying content to create your own course, programme, class plans, workshop, or business materials.
12.5 Any unauthorised use may result in legal action.
12.6 References to SENSSE® and EESE™ (including associated materials and frameworks) are protected and must not be used or reproduced without written permission.
13. Competitions and Prize Draws
13.1 We may run competitions or prize draws in connection with marketing campaigns, talks, events or promotions.
13.2 Eligibility requirements will be stated at the point of entry. Unless stated otherwise, one entry per person applies.
13.3 Unless stated otherwise, prizes are available to new patients only (meaning individuals who have not previously attended a clinical appointment with the Company).
13.4 Winners will be chosen at random and notified by email within seven (7) days of the closing date (or event date, where relevant).
13.5 Winners must claim their prize within seven (7) days of notification. If unclaimed, the prize may be forfeited and offered to another entrant.
13.6 Prize appointments must be booked and used within thirty (30) days of being claimed unless otherwise stated.
13.7 Prizes cannot be exchanged for cash, credit or alternative services and are non-transferable. Prizes cannot be used in conjunction with any other offer, promotion or discount.
13.8 Prize appointments are subject to the Company’s standard booking, cancellation and rescheduling policies.
13.9 By entering a competition, entrants consent to their personal data being used for administration of the competition and for follow-up communication, in accordance with our Privacy Policy.
13.10 We reserve the right to amend, suspend or withdraw a competition/prize draw where circumstances arise outside our reasonable control.
14. Events Outside Our Control (Force Majeure)
14.1 We are not liable for any failure or delay in performing our obligations where such failure or delay results from events outside our reasonable control, including (without limitation) illness, emergencies, building issues, utility failures, severe weather, or other unforeseen circumstances.
14.2 Where this occurs, we will contact you as soon as reasonably practicable and offer rescheduling where appropriate.
15. Written Communications and Notices
15.1 We typically communicate by email and/or telephone.
15.2 Any notice you give under these Terms must be in writing (email is acceptable) and sent to [email protected].
15.3 Notice will be treated as received when it is delivered to our inbox (we recommend requesting acknowledgment if time-sensitive).
16. Changes to These Terms
16.1 We may revise these Terms from time to time.
16.2 The Terms in force at the time you book or purchase will apply to that booking or purchase.
17. Severability
17.1 If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
18. Entire Agreement
18.1 These Terms and any documents expressly referred to (including the Privacy Policy) constitute the entire agreement between you and us relating to the services/products purchased and supersede prior discussions or representations.
19. Governing Law and Jurisdiction
19.1 These Terms and any disputes arising out of or in connection with them will be governed by English law.
19.2 The courts of England and Wales will have exclusive jurisdiction.
